Prices
are quoted in EUR, international invoices on request also in USD, GBP or CHF. |
Within
the EU 19% VAT is included if the customer doesn't state his EU-VAT-Id. No VAT
will be charged on
international sales. The customer has to pay customs and taxes according
to the law of the country of destination. |
The risks of loss or
damage during shipping and delivery lies with the buyer. If delivery is delayed by customer request,
risk transfers with the notification of delivery pending. For deliveries
to endusers in Germany the risk transfers with delivery. |
Goods
will always be delivered as soon as possible. If an item is back
ordered, the customer
will be informed as soon as possible. If the item is not available at all,
AMERICAN DANCEWEAR retains the right to deliver alternative goods of same or better
quality, or if necessary, cancel the order. |

via letter, fax, phone or online. |
| Products are shown as
catalog sample only. Given prices do not replace binding offers and are no
binding contract. When ordering online an order is binding for the
customer when the button "Bestellung abschicken" is pressed.
After sending an online-order the customer will receive an automatic
answer that confirms that the order was sent. For a contract binding for
us an additional oder confirmation or the goods will be sent. |

With credit card
payment the invoice total will be reserved on the credit card for the
payment. The final charge will take place with the shipment. Direct debit
will be made with the shipment. |

Return policy:
|
Returns
and exchanges may be made within two weeks of delivery of the goods
and this terms and conditions. The time period for returning goods starts,
at the earliest, the day after receiving the goods and the terms in
writing. The following goods are not returnable: |

Special orders; |

Orders according to personal requirements; |
| 3.
Audio CDs, videos, DVDs and software if the packaging has been opened. |
| For goods that can not
be shipped by package (extra large items) the customer may ask for
permission for an extension by written letter, fax or e-mail. To return
the goods in time it is sufficient to hand the package to the transport
company in time or to inform us in time if the goods can not be sent by
package. Within Germany the retail customer can send the goods back on our
cost. Return shipment or letters have to be directed to: |

| In case of a return,
customer and American Dancewear have to redeem the received goods or
services. If goods are returned in a condition that is not "as
new" the customer has to pay for the merchandise. This does not apply
if the same would happen when trying on in a shop. To avoid paying for
damages, the customer must refrain from using the goods and refrain from
doing anything that might damage the goods. |

Retention of Title:

Delivered
goods remain in the sole and absolute ownership of the selling company
American Dancewear until payment has been received in full. |
|
Law:

|
Contracts shall be governed by and interorated in
accordance with German law. The customer must submit to the jurisdiction of
the German law. American Dancewear may enforce the contract in any court of
competent jurisdiction. |

Privacy policy:
|
| Data
necessary for the customer relationship will be stored in computer files
and, if necessary, be forwarded for the fulfillment of orders. |
|
In
the case that a paragraph of the said terms and conditions is unvalid or becomes
unvalid, the other parts of the terms remain unaffected. The unvalid
paragraph will be replaced with a condition that replaces it as closely as possible. |

of catalogs (printed, CD or Online) may not be reproduced in whole or in
part without the prior written consent of AMERICAN
DANCEWEAR. |
